The Politics of the Uniform Civil Code

Context:

  • On June 27 in Bhopal, Prime Minister Narendra Modi urged the adoption of a Uniform Civil Code (UCC).

Equally important objectives:

  • The consequences of these two interconnected challenges would ultimately decide how India’s egalitarian efforts would develop.
  • A UCC has long been seen as a common objective, despite the fact that the Constitution only recommends one.
  • Even well-known secular public intellectuals have chosen not to take a strong stand in favor of it.

Personal freedoms and gender:

  • The democratic arc is gradually bending in favor of plurality, despite the fact that India may be moving in that direction.
  • Gender equality, a UCC’s primary priority, is a topic of discussion in many liberal democracies in Western countries, not just India.
  • For instance, comparable issues are dealt with by the French court system, which regularly involves Muslim immigrants from Algeria and Morocco. In Canada, Australia, and the US, religiously based alternative conflict resolution is often employed. Such measures might be advantageous for India.
  • Muslim personal law is yet another crucial UCC subject. The All India Muslim Personal Law Board (AIMPLB) was created in 1973 to protect Muslim personal law.
  • The colonial state first established personal laws based on religious grounds in 1772, though, therefore that is when personal law history actually began.
  • The Muslim Personal Law (Shariat) Application Act of 1937 and the Dissolution of Muslim Marriage Act of 1939 laid the foundation for Muslim law.
  • The triple talaq statute, which was passed in 2019, is one of the most significant revisions to personal law in recent years.

  • Putting an end to dated customs and procedures.
  • Promoting modernization and societal growth.
  • Addressing issues such as child marriage, divorce, and inheritance.

Uniform Civil Code’s associated issues:

Cultural and religious sensitivities:

  • loss of cultural and religious identity is conceivable.
  • Minority populations are opposed to interfering in the private lives of others.
  • sustaining diversity and multiculturalism in a multicultural society.

Implementation challenges:

  • pushback from conservative organizations and political parties.
  • Logistical difficulties arise while building a thorough and consistent code.
  • reconciling uniformity and local traditions and practices.
